A few years back, the Maryland Court of Appeals collected statistics on cases in different Maryland counties. There were only 46 auto accident cases filed in St. Mary’s County Circuit Court, and only 14 civil trials. In the District Court, there were 3,689 civil cases. St. Mary’s is still mostly rural, and jury verdicts tend to be conservative in personal injury cases. Of course, every case is different, and there have been a few instances of Leonardtown juries awarding substantial verdicts.

St. Mary’s County Settlements and Verdicts

  • $1.5 Million Verdict (St. Mary’s County 2024):  After undergoing a routine gallbladder removal surgery, a woman continued to experience severe abdominal pain. Upon further investigation, it was discovered that a 3-centimeter piece of her gallbladder had been left inside her body during the procedure. This remnant caused significant complications, including infections and persistent pain, leading to multiple additional surgeries. Medical experts testified that such remnants could lead to “post-cholecystectomy syndrome,” negating the surgery’s intended relief. The defense argued that leaving part of the gallbladder was a safer option given the patient’s anatomy, but the jury concluded that the medical professionals did not meet the required standard of care.
  • $1,000,000 Verdict (St. Mary’s County 2019): The plaintiff, an adult male, reportedly suffered an L5 vertebra fracture and a labral tear to his right shoulder resulting in permanent injury when the northbound vehicle in which he was a passenger collided with the right side of a southbound vehicle operated by defendant as she executed a left turn. The plaintiff contended that the defendant failed to yield the right-of-way to oncoming traffic, failed to pay full time attention to the operation of her vehicle and was otherwise negligent.
